नई दिल्ली, 19 सितंबर 2026: Former West Bengal Chief Minister और Trinamool Congress founder Mamata Banerjee ने Supreme Court का रुख किया है, जहां उन्होंने Election Commission के उस interim order को चुनौती दी है जिसमें All India Trinamool Congress का नाम और उसका ‘Flowers and Grass’ यानी ‘Jora Ghas Phul’ चुनाव चिन्ह temporarily freeze कर दिया गया था। उनकी writ petition 18 सितंबर को दाखिल की गई।
17 September को EC ने Freeze किया था Name और Symbol
Election Commission ने 17 September को TMC में चल रहे factional dispute के बीच interim order जारी किया था।
Commission ने कहा कि Mamata Banerjee और Ritabrata Banerjee के नेतृत्व वाले दोनों factions खुद को असली Trinamool Congress बता रहे हैं, इसलिए final decision होने तक original party name और reserved symbol किसी भी faction को इस्तेमाल करने की अनुमति नहीं होगी।
Mamata Faction को मिला ‘Football Player’ Symbol
Interim arrangement के तहत Mamata Banerjee-led faction को “Mamata All India Trinamool Congress” नाम और ‘Football Player’ election symbol दिया गया है।
Ritabrata Banerjee-led rival faction को “Democratic Trinamool Congress” नाम और ‘Envelope’ symbol allot किया गया है।
6 October के Bypolls के लिए लागू है व्यवस्था
Election Commission की यह temporary arrangement 6 October को होने वाले Nandigram और Rejinagar bypolls समेत आगामी चुनावों के लिए लागू होगी।
EC ने साफ किया है कि नए नाम और symbols का allotment original Trinamool Congress पर ownership का final फैसला नहीं है। मुख्य विवाद पर अलग से सुनवाई होगी।
Supreme Court में EC और Rival Faction को बनाया Respondent
Mamata Banerjee की petition में Election Commission of India और Ritabrata Banerjee को respondents बनाया गया है।
Petition में EC के interim order को challenge करते हुए original party name और ‘Jora Ghas Phul’ symbol के इस्तेमाल पर लगी रोक के खिलाफ relief मांगी गई है।
Mamata ने फैसले को बताया ‘Unconstitutional’
Mamata Banerjee ने EC के फैसले की आलोचना करते हुए इसे “unconstitutional, illegal and undemocratic” बताया है। उन्होंने इसे लोकतंत्र के लिए “black day” भी कहा। ये Mamata Banerjee के आरोप और राजनीतिक आकलन हैं; Election Commission ने अपना कदम rival claims के बीच interim व्यवस्था के रूप में बताया है।
Paragraph 15 के तहत होगा Final फैसला
Original TMC name और symbol किस faction को मिलेगा, इसका final determination Election Symbols (Reservation and Allotment) Order, 1968 के Paragraph 15 के तहत किया जाना है।
इस प्रक्रिया में Election Commission organisational और legislative support समेत दोनों camps द्वारा पेश किए गए documents और claims पर विचार करेगा।
